Data controller
The controller of your data is Sparkling Services SA (Sparkling Services), with its registered office at Rue des Anciens Étangs 40, 1190 Forest, company number BE 0873.407.695. For any question about your data, write to us through the contact form or call +32 485 39 99 41.
Data we collect
Contact and quote form
When you fill in the form, we collect your name, phone number, email address, the property postcode, the service you are interested in, your message and, if you add them, photos of the property. Photos are re-saved on arrival to remove their metadata (EXIF data, including GPS location). Please avoid attaching photos showing people or personal documents.
Chat assistant (AI chat)
If you use the chat assistant, the messages you type and the answers generated are processed to reply to you. We do not store the content of conversations on our servers: the history stays only in the open page of your browser and disappears when you leave it. Please do not share sensitive data (health, financial details, national register number) in the chat.
Technical data
Like any website, our server records limited technical data (IP address, browser type, pages visited, date and time) to keep the site secure and working properly. To limit abuse of the form and the assistant, we briefly keep an encrypted (pseudonymised) fingerprint of your IP address.
Why we use your data and on what legal basis
- Responding to your request and preparing a quote: pre-contractual steps taken at your request (Art. 6(1)(b) GDPR).
- Carrying out and invoicing the work: performance of the contract (Art. 6(1)(b)) and legal accounting and tax obligations (Art. 6(1)(c)).
- Answering your questions via the chat assistant: our legitimate interest in informing you quickly (Art. 6(1)(f)).
- Securing the website and preventing abuse: our legitimate interest (Art. 6(1)(f)).
We do not use your data for advertising, we do not sell it and we do not make any automated decisions that have legal effects on you.
The chat assistant and artificial intelligence
The chat assistant runs on Claude, an artificial intelligence model provided by Anthropic, which acts as our processor. The messages you type into the assistant, the language and the page you are viewing are sent to Anthropic solely to generate an answer to your questions. They are not used for advertising and are not sold. Anthropic is based in the United States, so this data is transferred outside the European Union (see "Transfers outside the European Union").
Legal basis: our legitimate interest in answering questions about our services quickly (Art. 6(1)(f) GDPR) and, where your question prepares a quote request, pre-contractual steps taken at your request (Art. 6(1)(b)). The assistant does not need personal data to answer you: please do not enter sensitive data (health, beliefs, financial details, national register number) or contact details; use the quote form if you would like us to contact you.
We do not keep the content of conversations. Anthropic keeps them for a limited period under its terms for business customers and then deletes them. The assistant's answers are generated automatically and may contain inaccuracies: they do not replace a written quote.
Recipients and processors
Your data is only accessible to the people at Sparkling Services who need it to handle your request. It may be shared with our technical processors, strictly as far as necessary: the website host, the email provider, Anthropic (provider of the AI model behind the chat assistant, only for the messages typed into the assistant) and, where applicable, our accountant. These processors are bound by a contract in line with Article 28 GDPR.
If you contact us via WhatsApp, your messages and photos pass through WhatsApp Ireland Ltd (Meta), under its own terms; we keep them for no more than 24 months.
We only disclose your data to third parties where required by law.
Transfers outside the European Union
Messages typed into the chat assistant are processed by Anthropic in the United States, outside the European Economic Area. Other processors may also process data outside the EEA. In every case, the transfer is covered by an adequacy decision of the European Commission or by the standard contractual clauses adopted by it, included in the data processing agreement, in accordance with Chapter V GDPR. You can ask us for information about these safeguards through the contact form.
How long we keep your data
- Quote requests that do not go ahead: no more than 24 months after the request, then deleted automatically.
- Client data: for the duration of the business relationship, then for the period required by Belgian accounting and tax law for invoices and supporting documents.
- Photos sent via the form: deleted automatically together with the related request, i.e. after 24 months at most.
- Messages and photos received via WhatsApp: 24 months at most.
- Chat assistant conversations: not kept on our servers; only technical counters with no content or identity (number of messages per day) are kept for 90 days. For retention by Anthropic, see above.
- Pseudonymised IP fingerprint (abuse prevention): 48 hours at most.
- Application technical log (errors, no message content): 6 months at most.
- Technical server logs: a few months at most.
Cookies and local storage
This website does not set any cookies: no advertising cookies and no analytics cookies. It only uses your browser's local storage (localStorage/sessionStorage) for the site to work: to remember the language you chose, your preference for reduced animations and, for the chat to work, whether the assistant is available. This information stays on your device, is not sent to us and can be cleared at any time in your browser settings. If non-essential analytics tools were ever added, they would only be activated with your prior consent.
Security
We apply appropriate technical and organisational measures to protect your data: encrypted connection (HTTPS), requests and photos stored outside the public part of the website with access limited to authorised people, removal of photo metadata, automatic deletion when the retention periods expire, and processors chosen for their security guarantees.
Your rights
You have the following rights at any time: access to your data, rectification, erasure, restriction of processing, objection, portability and withdrawal of your consent (without affecting the lawfulness of earlier processing). To exercise them, write to us through the contact form stating your request. We reply within one month.
If you believe your rights are not being respected, you can lodge a complaint with the Belgian Data Protection Authority (DPA), www.dataprotectionauthority.be.
Changes
We may update this policy to reflect changes to our services or to the law. The version published on this website is the version in force.
